Legal Education in Medical School : Goal, Future Direction and Approach Method

Abstract
This article aims to discuss on goals, future directions and approach methods relating to a legal education in medical school, and to reexamine the relation between medical ethics education and law education.
The purpose of legal education in medical school has to be understood as a coherent way to nurture the doctors as ethical professionals. The kernel of legal education in medical school is not simply to enhance overall humanitarian understanding but to comprehend the norm that is directly related to their profession as doctors. It is indispensable for doctors to recognize and fully understand legal issues related to medical area considering the fact that medicine has already been constrained by legal system of modern society.
It is true that legal education is in part covered by medical regulations education to prepare national examination, but that is not enough to fully achieve the purpose of medical humanities and social science. The legal education should not be limited to medical regulations but broaden to health law as a whole. That is, mere delivery of legal knowledge is not enough. The education should involve learning minimum legal mind to deal with various legal issues as a doctor. In order to make it possible, we have to elaborate integrated approach, and phased approach. One possible measure as phased approach is to classify the law education contents into what is core and advanced. The required courses should consist of core contents such as a concept of medical malpractice, basic medical malpractice cases and legal responsibilities of medical personnel. On the other hand, optional courses should consist of more advanced contents such as burden of proof about medical negligence and causality.
